ব্রিটিশ সরকার বিপ্লবীদের সাহস দেখে আশ্চর্য হয়েছিলো। ভাইসরয় স্কটল্যান্ড ইয়ার্ডকে নিয়োগ করে মামলাটি তদন্ত করবার জন্যে। এক মাসের মধ্যে সি.আই.ডি সূত্র বের করে ফেলে এবং প্রায় সব বিপ্লবীদের একরাতেই গ্রেপ্তার করার সিদ্ধান্ত নেয়। ২৬ সেপ্টেম্বর ১৯২৫ তারিখ সকালবেলা পণ্ডিত রামপ্রসাদ বিসমিল এবং অন্যান্য বিপ্লবীদের পুলিস গ্রেপ্তার করে কিন্তু আসফাক ছিলেন একমাত্র ব্যক্তি যার খোঁজ পুলিস পায় না। আসফাক লুকিয়ে পড়েন এবং [[Banaras]] যাত্রা করেন, সেখান থেকে [[বিহার]] গমন করেন এবং সেখানে একটি ইঞ্জিনিয়ারিং কোম্পানিতে দশ মাস কাজ করেন। তিনি বিদেশ যেতে চেয়েছিলেন এবং স্বাধীনতা সংগ্রামে মূর্ত সহায়তার জন্য [[Lala Har Dayal|লালা হর দয়ালের]] সাথে সাক্ষাত করতে চেয়েছিলেন। তিনি কীভাবে দেশ ত্যাগ করবেন তা বের করতে দিল্লি যান, সেখানে তিনি তার একজন পাঠান বন্ধুর সহায়তা নেন এবং সেই বন্ধুটিই বিশ্বাসঘাতকতা করে পুলিসকে জানিয়ে দেয় এবং আসফাককে পুলিস গ্রেপ্তার করে।
Ashfaq went into hiding and moved to [[Banaras]], from there he went to [[Bihar]] where he worked in an engineering company for about ten months. He also wanted to go abroad and meet [[Lala Har Dayal]] for his concrete help in the freedom struggle. He went to [[Delhi]] to find out how to move out of the country. In Delhi, he took the help of one of his [[Pashtun people|Pathan]] friend who in turn betrayed him by informing the police who arrested Ashfaq.

Ashfaqullaআসফাকউল্লা Khan was detained in theখানকে [[Faizabad]] jail.জেলে প্রেরণ করা হয়। A case was filed against him. His brother Riyasat Ulla Khan deployed Kripa Shankar Hajela, a senior advocate to plea his case as a counsellor. Mr Hajela fought the case till the very end but he could not save his life. While in jail, Ashfaq daily performed [[Namaz]] prayer five times reciting the verses from [[Quran]]. The case of the [[Kakori conspiracy]] was concluded by awarding death sentence to four daredevils, viz., Pandit Ram Prasad Bismil, Ashfaqulla Khan, [[Rajendra Lahiri]] and [[Thakur Roshan Singh]]. The sixteen others were awarded the rigorous punishment varying from four years up to life sentence.
By an eyewitness account, on a Wednesday, four days before he was hanged, two [[England|English]] officers looked into the solitary cell where Ashfaqulla Khan was lodged. He was in the middle of his namaz. "I’d like to see how much of that faith remains in him when we hang the rat", quipped one of them. But Ashfaq continued his prayer as usual and both of them went away murmuring like a wind's way.
